Promotions Terms and Conditions

We run promotions from time to time (each, a Promotion). Information on how to enter and prize details of each Promotion form part of these terms and conditions. By entering into a Promotion, you represent that you are eligible to enter and you are deemed to have accepted these terms and conditions.

The Promotions are run by Fuse Energy Supply Limited (company number 08469701) whose registered office is at Fuse Energy, Level39, One Canada Square, Canary Wharf, E14 5AB (Fuse, we, us, our).

Each Promotion starts at and ends at the time on the date set forth in the table at the end of these terms and conditions (each, a Promotion Period).

Each Promotion includes one entry into a pool with other eligible candidates from which one or more random winners may be selected to win the applicable Prize (see below).

For the purposes of these Promotions Terms and Conditions “Energy” means electricity, gas or both.

Who can enter?

Entry is open to residents of England and Wales and Scotland only who are 18 years or older and who satisfy the eligibility criteria described below under the heading “How do you enter?”.

By entering the Promotion, you agree to participate in our marketing activities including being interviewed and photographed, and that we (or our agent) may use your name, voice, photo and comments for marketing purposes for an unlimited time and in any media without reference or compensation to you.

How do you enter?

To enter, during the applicable Promotion Period:

An eligible residential property is a property located where Fuse operates on a tariff Fuse is currently able to service. Customers and properties that are already supplied Energy by Fuse do not qualify to enter the Promotion. Only one Prize per person and/or property is allowed, unless we decide otherwise.

The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.

Entrants agree and acknowledge that all eligible entries and any intellectual property rights subsisting in their entries become the property of Fuse.

The Prize

The selected winner(s) will win the Prize applicable to the relevant Promotion.

Where applicable, the winners will be decided by a randomly selected draw. The first valid eligible entry drawn will win the Prize in a particular Promotion.

Winner(s) will be notified via the Fuse mobile application within five days of the draw. Winners must confirm they accept the Prize in order to receive the Prize.

Our decisions about the Promotion (including the selection of winner(s)) are final and no correspondence will be entered into.

Unclaimed prize draw

Any unclaimed prize draw shall automatically lapse one week after the relevant winner is notified. No payment in lieu of any Prize is available.

Prize conditions

Only one Prize per eligible entry per Promotion.

We reserve the right to withdraw a Prize if there are no eligible entrants to receive it. We also reserve the right to cancel any Prize at our sole discretion for any reason or no reason at all, at any time.

A Prize, or any unused portion of a Prize, cannot be transferred, exchanged or redeemed for cash or anything else. Expenses relating to a Prize are the responsibility of the winner.

In order to accept a Prize, a winner may be required to sign a legal release and indemnity form.

General

We reserve the right to: (a) ask you to provide proof of identity and/or proof of eligibility to claim a Prize, (b) determine how each Promotion is run, including the selection of a winner, and (c) disqualify any entrant who we believe has breached these terms and conditions or engaged in unlawful or other improper conduct or any conduct intended to jeopardise the fair and proper conduct of the promotion.

We accept entries upon receipt by us. It's your responsibility, not ours, to ensure we receive your entry. We aren't responsible for any lost, late or misdirected entries or entries not received by us for any reason. We aren't responsible for technical difficulties with the entry mechanism and we don't warrant that the entry mechanism will be available at all times.

Any entrant who, in our opinion, tampers or interferes with the entry mechanism in any way, or who doesn't properly comply with the entry process, will be ineligible to win. We reserve the right to disqualify entries in the event of non-compliance with these terms and conditions.

We aren't responsible for a Prize that may be lost, stolen, forged, damaged or tampered with after it leaves us or our agent, or changes in Prize value.

If we're unable to run a Promotion as planned, including due to tampering, unauthorised intervention, fraud, technical difficulties or any other causes beyond our control, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, we reserve the right to take any action that we consider necessary, including but not limited to (a) disqualifying any entrant, or (b) modifying or cancelling the Promotion, subject to directions from regulators.

We exclude all warranties in relation to the quality, suitability or merchantability of all Prizes, except those that cannot be excluded by law. To the extent permitted by law, any liability of us or our employees or agents for breach of any rights a consumer may have which are unable to be excluded under English law is limited to paying for the resupply of the applicable Prize.

To the extent permitted by law, we aren't liable for loss (including indirect and consequential loss), damage or personal injury suffered or sustained in connection with any Promotion (including the supply of goods or services by anyone to a Prize winner), and to anyone accompanying a Prize winner (if applicable).

All costs associated or arising in connection with participating in any Promotion and any Prize are the responsibility of entrants. Any costs associated with accessing the internet are the entrant's responsibility, and depend on the internet service provider used.

We're not responsible for tax (including GST, VAT) obligations of any nature that may arise from winning a Prize, so please seek your own independent tax advice.

Where the Prize is a value of Energy supplied, Fuse will award the Prize in any method it deems appropriate, provided that the Prize equals but does not exceed a value of £1,000 (calculated on the date the winner is selected and not adjusted). Such methods include but are not limited to a cash transfer, a credit of the customer's wallet in the Fuse mobile application, payment of the customer's Fuse Energy bill, a reduction of the customer's Energy bill, and any combination of the foregoing. Such Prizes may be awarded all at once or in instalments over a 12-month period, at Fuse's sole discretion.

Privacy

We collect personal information about you to include, and administer, your entry in the promotion in accordance with these terms and conditions, and where appropriate, award a prize. Specifically, we collect personal information about you (a) to conduct a Promotion and determine and notify a winner, and disclose such information to Prize suppliers and regulators, and (b) for marketing purposes at any time and in any media, including to contact you after the applicable Promotion ends.

By participating in any Promotion, you consent to us collecting and using your personal information, and disclosing your personal information to the relevant authorities, our related entities, agencies, promotion partners and other third parties engaged to provide services in connection with the Promotion, for the purposes listed above and in accordance with our privacy policy available at https://www.fuseenergy.com/legal/privacy-policy. If the personal information requested is not provided, we will be unable to process your entry and your entry will therefore be deemed invalid.

You agree to provide your consent until such a time as it is withdrawn by giving notice to us. You can also gain access to, update or correct any personal information held by contacting us using the details listed in these terms and conditions.

Referral Reward Terms and Conditions

These are terms and conditions applicable to Fuse Energy’s referral rewards campaign. The referral rewards campaign gives certain referring customers and referred customers the chance, without guarantee, to win up to £150 (inclusive of GST) of credit to be applied to the customer’s Fuse Energy energy supply account (the credit). The chance to win the credit will only be available during live campaign periods (the campaign periods), as communicated by us.

1. Applicability

These terms apply to (1) an existing Fuse Energy customer, who refers friends and family to Fuse Energy (the referring customer) and (2) a new customer, who follows the unique URL provided to them by the referring customer, in order to initiate a switch to Fuse Energy (the referred customer).

If all eligibility criteria are met, eligible customers will receive a chance to win the credit. The chance will be in the form of a “spin” within the Fuse mobile application. The “spin” will stipulate how much credit (if any) the eligible customer may receive, provided that all remaining eligibility criteria are met.

The maximum amount of credit that a referring customer can win is £150 with respect to each referred customer. The minimum amount of credit that a referring customer can win is £0 with respect to each referred customer.

The maximum amount of credit that a referred customer can win is £150 and the minimum amount is £0.

There is no guarantee that credit will be won upon satisfaction of the eligibility criteria. A “spin” may result in £0 credit won.

4. When will the customer receive the credit?

Fuse Energy will apply the credit as an offset against the charges only on the customer’s subsequent bills until the credit is used in full. The credit amount is a bill credit only and not available for refund or redeemable for cash.

5. Variation and cancellation

We reserve the right to cancel or amend the terms of this campaign in our sole discretion and without prior notice. In the event of any dispute regarding any aspect of the referral reward campaign, our decision shall be final.
